Terms of Service

1. Agreement

These Terms of Service govern your use of the Pousoraro website and property-alert service. By creating an account or using the service, you agree to these terms and to our Privacy Policy.

If you do not agree, do not use Pousoraro.

2. The service

Pousoraro monitors selected real estate portals and notifies you about new listings that match the search alerts you set up. We currently cover portals such as QuintoAndar, VivaReal, Zap Imóveis, and OLX, and we may add or remove sources over time.

Pousoraro is not a real estate agency, broker, or the seller or landlord of any property. Listings are published by third parties. We do not guarantee that any listing is complete, accurate, available, or still on the market.

When you open a listing you may leave our site and deal directly with the portal or advertiser. Their terms, fees, and privacy practices apply to that interaction.

3. Accounts

You must be at least 18 years old to use Pousoraro. You agree to provide accurate information and to keep your login details confidential. You are responsible for activity on your account.

We may refuse, suspend, or close an account if we reasonably believe these terms have been breached or the service is being abused.

4. Acceptable use

You may use Pousoraro only for lawful personal or internal purposes related to searching for properties. You must not attempt to scrape, overload, reverse-engineer, or interfere with the service; create alerts or accounts in a way that harms other users or our providers; or use the service to send spam or to collect data about other people without a lawful basis.

Alerts are for your own use. You may not resell or systematically republish our notifications as a competing service.

5. Alerts and availability

We aim to notify you quickly after a matching listing appears — often within a few minutes — but we do not guarantee timing, delivery, or that every matching listing on every portal will be captured.

Email and WhatsApp delivery depend on those networks and on the details you provide. You are responsible for keeping your email, phone number, and notification preferences up to date.

6. Plans, payments, and cancellation

Pousoraro may offer a free plan and paid plans with different limits or features. Current prices and benefits are shown on the site and may change for future billing periods.

Paid subscriptions are processed by Stripe. By subscribing you also agree to Stripe’s terms for the payment itself. We do not store your full card number.

You may cancel a paid plan at any time from your account. Access to paid features continues until the end of the period you already paid for, unless Brazilian law requires otherwise.

If you buy a paid plan as a consumer using the website, Brazilian Consumer Defense Code (CDC) rules may give you a seven-day cooling-off period for distance purchases. Statutory consumer rights are not limited by these terms.

7. Intellectual property

The Pousoraro name, logo, website design, and software belong to us or our licensors. You may not copy, modify, or reuse them except as needed to use the service.

Listing photos, descriptions, and other listing content belong to the portals or their advertisers. We display them only as needed to provide alerts.

8. Disclaimer

The service is provided on an “as is” and “as available” basis. To the extent permitted by law, we disclaim warranties that the service will be uninterrupted, error-free, or that alerts will lead to a successful purchase or rental.

Nothing in these terms limits rights that cannot be waived under the Brazilian Consumer Defense Code or other mandatory law.

9. Limitation of liability

To the extent permitted by law, Pousoraro is not liable for lost property opportunities, listing inaccuracies, decisions you make based on an alert, or failures of third-party portals, email, WhatsApp, or payment providers.

This limitation does not apply to liability that cannot be excluded under Brazilian law, including liability for fraud or for damages caused by intent or gross negligence where the law so provides.

10. Termination

You may stop using the service and request that we close your account. We may suspend or terminate access if you breach these terms, if we discontinue the service, or if we are required to do so by law. Sections that by their nature should survive (including intellectual property, disclaimers, and limitation of liability) remain in effect.

11. Governing law

These terms are governed by the laws of Brazil. Disputes shall be submitted to the courts of São Paulo, State of São Paulo, without prejudice to a consumer’s right to sue in their own domicile where the Consumer Defense Code so provides.

12. Changes to these terms

We may update these Terms of Service. The “Last updated” date at the top will change when we do. If you continue to use Pousoraro after the updated terms take effect, you accept the new terms for your future use. If you do not agree, you should stop using the service and close your account.
